PURCHASE OF ONLINE-TICKETS THROUGH CHARACTER DRIVEN MEDIA 1.Area of Application These General Terms and Conditions apply to the sale of admission tickets in the form of electronic tickets (online-tickets in the following) for cultural, entertainment or other leisure-time events through the internet at the web site www.gigtickets.org. The General Terms and Conditions apply to all services and work in connection with the reservation, purchase and provision of online-tickets, as well as to any disruptions to the provision of same. www.gigtickets.org is the official internet presence of GIGTICKETS.ORG. Upon first registration, you confirm cognizance and binding acceptance of these General Terms and Conditions. The respective current version of the General Terms and Conditions can be seen/downloaded as a separate menu box at any time. Any alterations to these General Terms and Conditions will be sent to all registered customers by e-mail to the e-mail address provided by you. Following any such alteration of the General Terms and Conditions, you have to confirm consent thereof explicitly by clicking on the relevant dialogue box. Beside these General Terms and Conditions also the General Terms and Conditions (incl. Rules of the House) of the respective organizer apply at the respective venue or festival site. 2. Purchase of Concert Tickets as Online-Tickets 2.1 Admission tickets for leisure-time cultural events can be purchased in the form of an online-ticket at www.gigtickets.org. Therefore it is first necessary to register at the pertinent input box of www.gigtickets.org, stating name, address, telephone number, e-mail address and a password chosen by you. After registration has taken place, we will send you the chosen password by e-mail. How you then use the e-mail and/or the password, whether you save or delete such, make such available to a third party or not is for you to decide. GIGTICKETS.ORG will not accept any liability for any abuse of the password. GIGTICKETS.ORG recommends not disclosing the password to any third party. 2.2 The contract on the purchase of online tickets is solely concluded between GIGTICKETS.ORG and you. Unauthorized duplication or sale of this ticket will prevent your admittance to the event. Please check your barcode number and print only one of each unique ticket where exact copies are issued. GIGTICKETS.ORG and CHARACTER DRIVEN MEDIA are third party providers, supplying ticketing services and their services are strictly limited to the provision of tickets. GIGTICKETS.ORG and CHARACTER DRIVEN MEDIA is in no way associated with or connected to the events for which they supply tickets. Event organizers are solely responsible to audience members for all aspects of their event or production. In negotiating this ticket the holder is verifying that GIGTICKETS.ORG and CHARACTER DRIVEN MEDIA holds no responsibility for the content or quality of the event for which the ticket was purchased and bears no responsibility for show cancellations, refunds or any other event-related matters which may arise. 2.3. Online-tickets can be purchased up to six hours prior to the time of admission to the event in question. GIGTICKETS.ORG reserves the right to extend or reduce the purchase period in individual cases or for individual events and will not assume any liability regarding a specific purchase period. The legally binding offer to purchase a ticket is made by you once you have clicked on the dialogue box. The contract between you and GIGTICKETS.ORG will come about upon allocation and provision of a personal code. GIGTICKETS.ORG reserves the right to decline your offer at any time without being required to state grounds. A maximum of ten (10) online-tickets or less (depending on the event) can be bought by any one person. Multiple online-ticket purchases in excess of this number achieved by giving several e-mail addresses or by other improper means are expressly forbidden. You have no legal claim to the purchase of a ticket. Character Driven Media, at its own discretion, reserves the right to impose further restrictions with regard to the number of available online-tickets in individual cases or for specific events. If, for whatever reason, the number of online-tickets desired by you is not available, you will be notified prior to the conclusion of the purchase contract. You're then no longer bound by your offer. You have to place a new order. 2.4 Payment of online-tickets will be by credit card or other methods listed on the site. 2.4.1. Payment by credit card is done only by means of an encoded online payment system (SSL - Secure Socket Layer) with up to 120 bits, depending on your browser configuration. Payment by credit card requires entry on the input form of the name of the holder of the credit card, the credit card number plus any PIN number and the period of validity of the credit card on the input form. GIGTICKETS.ORG accepts payment by credit card by no later than six (6) hours before admission to the chosen event. You need the free Adobe Acrobat Reader in order to view and/or make printouts of PDF files. Download the Adobe Acrobat Reader at www.adobe.com. 2.5 The online-ticket remains the sole property of GIGTICKETS.ORG until full payment is received. Resale to third parties for commercial reasons is expressly forbidden! This concert ticket grants admission to the event only to the authorized initial buyer and/or to the person(s) to whom the first buyer has transferred the ticket for private purposes and without profit-making intent. GIGTICKETS.ORG reserves the right to refuse admission to the concert to persons who were resold this ticket for commercial purposes by persons other than GIGTICKETS.ORG or its authorized partners. In addition GIGTICKETS.ORG reserves the right to exclude persons breaking aforesaid rules from future online-ticket purchases. 2.6. In case of abuse (unauthorized circulation, multiple-shift usage or similar) or missing / incomplete payment GIGTICKETS.ORG will block the online ticket / authorized code without prior notice. So the admission to the concert is no longer possible (neither in case of subsequent / later payment). 2.7. You alone are responsible for the security of the authorization code. Towards GIGTICKETS.ORG / the respective organizer you can not appeal to the fact, that another person entered the concert by showing your authorization code. 3. Refunds 3.1 Unless the event in question has been cancelled definitively or the date of the event been changed, no right to return or refund the online-ticket exists except on the basis of compelling legal grounds. Insofar as you are entitled to a refund of the purchase price of an online-ticket, you must claim such a refund in the case of final cancellation of the event in question no later than four (4) weeks after having been notified of such a cancellation, and in the case of a different date must claim such a refund no later than ten (10) hours before admission begins to the postponed event unless something else has been agreed in the individual case. Should you not be able to make his or her claim to a refund on grounds beyond his control within the prescribed period - e.g. illness - you are obliged to provide proof as to why you were unable to make such a claim. Any refund of the price of an online-ticket will be processed through the event organizer directly and will be contingent upon the rules which apply to their venue events. The price of the ticket(s) will be credited by the event organizer to the same account of the credit card organisation which was debited with the purchase of the ticket(s) in question. 3.2 The risk in respect of all data named by you in the order dialogue lies entirely with you. In particular, you bear the risk of any errors in the placement of orders, in particular if you erroneously entered a date or an event other than the one intended. It is your obligation to check the PDF file authorizing you to purchase the online-ticket in terms of the data contained in the file (number of tickets, price, event, event location, date of event), in particular with regard to concurrence with your order, and to lodge any complaints with us regarding discrepancies without delay - either by telephone or by e-mail. No claim to reversal of the transaction will otherwise exist. In cases of doubt, the onus of proof to show that a check without delay was not possible for reasons beyond your control lies with you. 3.3. Online-tickets are not issued to a specific person and can therefore be transferred to any third person. The authorization code authorizes admission to the event to the person who first submits this code to the organizer on the day of the event. Each access code only gives admission to one person. You bear sole responsibility for safeguarding the authorization code. We assume no liability in this matter. You cannot claim GIGTICKETS.ORG or the individual organizer that another person has gained admission to the event without your permission by presenting your authorization code. 3.4. If you are- irrespective of the reasons - unable to present the authorization code at the event location, you have no right of admission. The purchase price will not be refunded in such a case. 4. Liability, Warranty In the context of the contract, GIGTICKETS.ORG will assume unlimited liability in all cases of loss of life, personal injury, and harm to health for which it is culpable. Otherwise, GIGTICKETS.ORG will only accept liability in the case of a breach of contract arising from gross negligence and/or intended breach of contract unless primary obligations (known as cardinal contractual obligations) are breached. Otherwise, liability is confined to 50.00 per instance of breach of contract. GIGTICKETS.ORG will not assume any liability for any disruptions due to circumstances beyond its control. This also applies to disruptions occurring during use of the online service of the www.gigtickets.org website due to interruptions or disturbances to the telecommunications network and/or the electricity supply. Given the technical features of the internet, it is not possible to guarantee that all reservation modules at www.gigtickets.org will be available at all times. 5. Your Obligations when Attending an Event 5.1 Dangerous objects such as gas containers, pyrotechnical articles, wick torches, weapons of any kind, as well as items that could be used as projectiles - particularly bottles and cans - may not be taken in at any event. 5.2 Recording devices, analog or digital, cameras of any kind, analog, digital or other as well as of any kind of video cameras may not be taken into or operated at events. Photographs/recordings in any form are prohibited, regardless of the medium or capure device. Any persons violating these bans will be liable to legal prosecution. 6. Film and Digital Recordings of the Organizer You agree - without receiving any remuneration from GIGTICKETS.Org or the respective organizer - that both are authorized to take film or digital recordings of you on the basis of the event, to manifold, send or publish them as well as use or let them be used in audio-visual media of any format for the purposes of promotion or other venue or business-related events and applications. 7. Other provisions These General Terms and Conditions constitute all the agreements between us. No further individual agreements, verbal or other ancillary agreements exist. Should any of the individual provisions of these General Terms and Conditions be or become without legal force, this shall not affect the legal force of the other provisions. Any provision without legal force shall be replaced by one with legal force which most closely reflects the purpose of the contract intended by the parties. The same shall apply mutatis mutandis should anything have been omitted from the contract. Canadian law shall apply exclusively. 8.
